Heard learned counsel for the petitioner.

The petitioner, aggrieved by an oder passed by the Collector, Muzaffarnagar dated 5th October 2006 whereby petitioner's application for transfer of his case from the court of Deputy Director of Consolidation to some other competent court has been rejected, has approached this Court by means of this writ petition under Article 226 of the Constitution of India.

I have gone through the order which gives full reasons for rejection of transfer application. The petitioner earlier also has filed a transfer application which has been rejected. Then the petitioner preferred a revision before the Board of Revenue. The Board of Revenue directed that the transfer application may be decided after hearing the parties. Thereafter the transfer application was rejected as it was found baseless.

Before this Court the petitioner submitted that he has given reasons that he does not have any hope of justice from the officer concerned as the local political leader has close nexus with the authority concerned who is one of the parties in the revision itself. No material has been placed before the Collector or this Court from where it can be asserted that the statement made by the petitioner is correct. It is open to the petitioner to file an application before the authority concerned levelling the same objection as has been taken in this petition.

I do not find any force in this writ petition. It is accordingly dismissed.
