Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. has been registered in pursuance of the order passed by the learned Magistrate under Sections 156(3) Cr. P. C. In the F.I.R. itself it is clearly stated ht the first informant and his other family members reached the place of occurrence and saw the dead body of the deceased lying in courtyard, but it is very surprising that the cremation of the dead body was done with the consent of the first informant and his family members, because there was no complainant against the applicant. The F.I.R. has been lodged after great thought and consultation.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Pinku Singh involved in Case Crime No. C-12 of 2006, under Sections 498-A and 304-B I.P.C. and Sections ¾ Dowry Prohibition Act, Police Station Khudaganj District Shahajahanpur be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
