This is an application for bail moved on behalf of the applicant Srichandra involved in case Crime No. 242 of 2006 under section 307, 323 I.P.C., Police station Binchwan, district Mainpuri.
Heard Sri V.K. Sharma, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is said to have opened fire at the injured but according to the supplementary medical report injury was caused by blunt and hard object. The learned counsel pointed out that injury is of simple nature.
The learned AGA contended that specific role of opening fire has been assigned to the applicant and injury is on vital part of the body, i.e. chest.
I have taken into consideration the submissions advanced on behalf of both the parties.
According to the supplementary medical report injury is of simple nature and caused by blunt object. Looking to the nature of the injury, I consider it to be a fit case for bail.
Let the applicant Srichandra involved in case Crime No. 242 of 2006 under section 307, 323 I.P.C., Police station Binchwan, district Mainpuri be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
