This is an application for bail moved on behalf of the applicant Vinod Kumar involved in case Crime No. 222 of 2006, under sections 147, 148, 149, 307, 353, 332, I.P.C. and section 7 of Criminal Law Amendment Act, Police station Surajpur, district Gautam Budh Nagar.
Heard Sri Brij Lal Shukla, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is not named in the first information report and his name came to surface from the statement of the injured recorded five days after the incident. The learned counsel urged that there is no criminal history of the applicant.
The learned AGA argued that the applicant and co-accused who were members of another gang opened fire at the accused Shatru alias Sher Singh and Singh Raj who were being taken to the court from jail and critically injured them.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant is not named in the first information report. His name came to surface from the statement of injured five days after the incident. The case of the applicant is distinguishable from the named co-accused. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Vinod Kumar involved in case Crime No. 222 of 2006, under sections 147, 148, 149, 307, 353, 332, I.P.C. and section 7 of Criminal Law Amendment Act, Police station Surajpur, district Gautam Budh Nagar, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned
