Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents no. 1 to 3. In view of the nature of the order which is being passed, notices to respondents no. 4 and 5 are not being issued. However, in case if the said respondents are so aggrieved, they shall be at liberty to file an application for modification, variation and/or recall of this order.

The submission of the learned  counsel for the petitioner is that alleged elections of the Committee of Management of the college in question are said to have been held by the District Inspector of Schools on 2.7.2006 which could not have been held in view of the interim order dated 31.1.2003 passed in Writ Petition No. 13495 of 2003 and also till final decision was taken with regard to the earlier election held on 5.8.2002.

Admittedly the papers relating to the election dated 2.7.2006 have been forwarded to the Regional Committee, respondent no. 2 and no decision has yet been taken with regard to the same.

Having heard learned counsel for the parties and considering the facts and circumstances of this case, this writ petition is finally disposed of with the direction that the Regional Committee, respondent no. 2 shall take a decision with regard to the elections of the Committee of Management held on 2.7.2006 after considering the objections of the petitioner and after giving opportunity of hearing to the petitioner as well as respondents no. 4 and 5 and other concerned parties, if there be any, expeditiously.

With the aforesaid observations/directions, this writ petition is finally disposed of. No order as to costs.
