This is third bail application. The First Bail Application No. 5517 of 2004 has been rejected by this court on 13.12.2004 considering the case on its merits. Thereafter, Criminal Misc.(Second ) Bail Application No. 12720 of 2005 has already been rejected by this court on 8.8.2005.

From the perusal of the record it appears that the grounds taken in this bail Application have already been considered. There is no new good ground to release the applicant on bail. Therefore, the prayer for bail is refused on its merits.

However, considering the illness of the daughter of the applicant and his conduct that he has surrendered before the court concerned after remaining on short term bail for a period of one month, and he has not misused such liberty the applicant is entitled for short term bail for a period of thee months from the date of his release.

Let the applicant Rajesh Kumar Singh        involved in case crime no. 112      of 2003 under Sections    498-A,304_B,201  I.P.C., and under section ¾ D.P. Act    P.S. Rohaniya      District Varanasi  be released  from Jail on shot term  bail for a period of three months  from the date of his release on his furnish   a personal bond and heavy sureties each in the like amount to the satisfaction of the Court concerned with the condition that he shall appear before the court concerned immediately on the date of expiry of the short term bail.
