This is an application for bail moved on behalf of the applicant Ramanand involved in case Crime No. 1209-C of 2006, under sections 323, 376, 511, I.P.C., Police station Chandpur, district Bijnor.

Heard Sri Mohammad Afzal, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that on 1.8.2006 at about 7 p.m. the applicant and his mother was subjected to assault by the husband of the victim and another accused and first information report was lodged  on 2.8.2006, which was registered  as case Crime No. 1119 of 2006 under section 323, 504, 506 I.P.C. and section 3 (ii) (v) of SC/ST Act. The learned counsel argued that first information report of the present case was registered in compliance of an order passed under section 156 (3) Cr.P.C. The learned counsel argued that the application under section 156 (3) Cr.P.C. was moved one month after the incident giving a concocted version.

The learned AGA submitted that the applicant took away complainant's wife to the field with an intent to commit rape on her.

I have taken into consideration the submissions advanced on behalf of both the parties.

The applicant lodged the first information report against the victim's husband on 2.8.2006 about the incident which took place on 1.8.2006. The first information report of the present case was registered in compliance of an order passed on the application made one month after the alleged incident under section 156 (3) Cr.P.C. In view of these facts, I consider it to be a fit case for bail.

Let the applicant Ramanand involved in case Crime No. 1209-C of 2006, under sections 323, 376, 511, I.P.C., Police station Chandpur, district Bijnor, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned
