Heard learned counsel for the applicant and learned A.G.A. for the State.

It is submitted by learned counsel for the applicant that the statement of the prosecutrix under Section 161 Cr.P.C. has been recorded by the investigating officer and after recording the said statement and after doing investigation the police has submitted a final report in this case and there is inordinate delay in recording the statement under Section 164 Cr.P.C. She was also not medically examined.

Considering the facts and circumstances and without expressing any opinion on the merit of the case let the applicant, Sanjay, involved in Case Crime No. 105 of 2006 under Sections 376 and 506 I.P.C., Police Station Kakod, district Gautam Budh Nagar, be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of court concerned.
