This is an application for bail moved on behalf of the applicant Shaukat involved in case Crime No. 336 of 2006, under sections 379, 411 I.P.C. and section 135 of Electricity Act, Police station Baghpat, district Baghpat.
Heard Sri Ram Raj Pandey, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that recovery of electric wire is said to have been made in pursuance of joint disclosure statements of the applicant and co-accused.
The learned AGA argued that recovery of stolen electric wire was made on the pointing out of the applicant and co-accused.
I have taken into consideration the submissions advanced on behalf of both the parties.
The offences are triable by the Magistrate Ist Class. The applicant is in jail for the last more than three months. The recovery of electric wire was made in pursuance of the joint disclosure statements of the applicant and three co-accused. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Saukat involved in case Crime No. 336 of 2006, under sections 379, 411 I.P.C. and section 135 of Electricity Act, Police station Baghpat, district Baghpat, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
