Heard learned counsel for the applicant and learned A.G.A. for the State.

It is submitted by learned counsel for the applicant that the applicant has been falsely implicated in this case. The alleged recovery of narcotic  is below the commercial quantity. The applicant has got no criminal history.

Considering the facts and circumstances and without expressing any opinion on the merit of the case let the applicant, Shyam Singh, involved in Case Crime No. 272 of 2006 under Section 18/20 N.D.P.S. Act, Police Station Sainya, district Agra, be released on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of Chief Judicial Magistrate concerned.
