This is an application for bail moved on behalf of the applicant Ram Baran Nishd involved in case Crime No. 355 of 2006, under sections 41/411, 467, 468, 471, 419, 420 I.P.C., Police station Kotwali Nagar, district Banda.
Heard Sri R.C. Yadav, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the name of the applicant came to the fore from the confessional statement of Zafar Khan who is said to have sold the stolen vehicle to the applicant. The learned counsel urged that recovery of stolen vehicle was not made from the possession of the applicant.
The learned A.G.A argued that the stolen vehicle was sold by the co-accused to the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The recovery of stolen Bolero jeep having not been made from the possession of the applicant, I consider it to be a fit case for bail.
Let the applicant Ram Baran Nishd involved in case Crime No. 355 of 2006, under sections 41/411, 467, 468, 471, 419, 420 I.P.C., Police station Kotwali Nagar, district Banda, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
