Satya Pal & Another v. Addl. Commissioner (Ii) Allahabad Mandal, Allahabad & Others - WRIT - C No. 59739 of 2006 RD-AH 18574 (2 November 2006)
Hon'ble Anjani Kumar, J.
Heard learned counsel for the petitioners, the learned Standing Counsel for respondents 1 and 2, Sri V. K. Singh, learned counsel for respondent no. 3 as well as Sri S.S. Mishra, learned counsel for respondent no. 4.
The petitioners aggrieved by the order passed the Additional Collector dated 8th June, 2005, whereby the application moved by them under Section 198 (4) of the U.P. Zamindari Abolition and Land Reforms Act, 1950 for cancellation of the lease deed granted in favour of the contesting respondent, has been rejected, approached the revisional authority. The revisional authority vide its order dated 25th September, 2006 maintained the findings recorded by the Additional Collector and dismissed the revision filed by them. Thus, this writ petition.
I have gone through the orders impugned in the present writ petition. Learned counsel for the petitioners has not been able to demonstrate that the orders passed by the Additional Collector as well as by the Additional Commissioner in any way suffer from any error, much less error apparent on the face of record, so as to warrant any interference by this Court in exercise of power under Article 226 of the Constitution of India.
In view of what has been stated above, this writ petition has no force and is accordingly dismissed. However, there shall be no order as to costs.
