Heard learned Counsel for the applicant, learned A.G.A. and Km. Satya Srivastava learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R., whereas co-accused Deepak Shahni alias Kiran alias Nathuni is named in the F.I.R. and the role of causing injury by firearm is assigned to co-accused Deepak Shahani, but during investigation the name of the applicant has been disclosed by the witness Durga Prasad on 15.7.2006 in which the role of causing injury is assigned to co-accused Deepak Shahni. The case of the applicant is distinguishable with the case of co-accused Deepak Shahani.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Arbind Kumar Singh involved in Case Crime No. 245 of 2006, under Sections 302 and 120-B I.P.C., Police Station Lanka District Varanasi be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
