This is an application for bail moved on behalf of the applicant Rajesh Kumar Dwivedi alias Kallu involved in case Crime No. 63 of 2006, under sections 307, 324, 504, 506, I.P.C., Police station Holagarh, district Allahabad.
Heard Sri Arun Srivastava, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the injuries are on non-vital part of the body and no internal damage was found in the X-ray.
The learned AGA argued that role of opening fire has been assigned to the applicant and injuries are on vital part of the body.
I have taken into consideration the submissions advanced on behalf of both the parties.
The X-ray of the injured indicates presence of four radio opaque shadow of metallic density small in size subcutaneously in left shoulder and left upper arm. Looking to the nature of injury, I consider it to be a fit case for bail.
Let the applicant Rajesh Kumar Dwivedi alias Kallu involved in case Crime No. 63 of 2006, under sections 307, 324, 504, 506, I.P.C., Police station Holagarh, district Allahabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
