The petitioners aggrieved by an order passed by the Board of Revenue in a revision under Section 333 of U.P. Zamindari Abolition & Land Reforms Act (hereinafter referred to as the Act) whereby the Board of Revenue has refused to interfere with the order passed by the Additional Commissioner who recalled the order passed by the trial court whereby the trial court has decided the matter exparte and remanded back the matter to the trial court.
I have gone through the order passed by the Board of Revenue as well the trial court. As observed by the Board of Revenue it is a matter remanding back the matter to the trial court. The matter has yet not been decided on merits. Admittedly the order passed by the Additional Co missioner is an interlocutory order. It is open to the petitioner to pursue the trial court for the prayer which has been made in this writ petition.
The writ petition has no force and is dismissed.
