It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. During investigation the I.O. has collected some evidence showing that the deceased was taken by the applicant from his house. Subsequently, the dead body of the deceased was recovered and there is no other evidence against the applicant.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Neeraj Kumar involved in Case Crime No. 302 of 2006, under Sections 302 and 201 I.P.C. , Police Station Modinagar District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
