Heard learned counsel for the applicant and the learned A.G.A. and Sri M.A. Hasan, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that in the present case, the allegation of causing injury is assigned to the applicant and other co-accused by using lath and danda blows. The co-accused Ram Kumar has been released on bail by this court on 7.9.2006 in criminal misc. bail application no. 18360 of 2006. Therefore, the applicant is also entitled to get the benefit of parity.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Padam Singh involved in case crime no. 61 of 2006 under Sections 147,302 I.P.C., P.S. Behraigarh District Saharanpur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
