Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that there is a cross version of the alleged occurrence. From both side F.I.Rs have been registered. Both side have received injuries. From the prosecution side one person has lost his life and four persons have received injuries. From the applicants side five persons have received injuries. The injuries received by the applicants side have not been explained. The prosecution has not come with clean hands.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Pappoo and Kamlesh involved in case crime no. 327 of 2006 under Sections 147,148,149,304,308,452,324,323,325,504,506 I.P.C., and 3(2)(5) S.C./S.T. Act P.S. Rudhauli District Basti be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
