This is the second bail application moved on behalf of the applicant Rajesh Yadav alias Guddu Yadav involved in case Crime No. 214 of 2005, under sections 302, 120-B, 506, I.P.C., Police station Tarwa, district Azamgarh.
Heard Sri Lalta Prasad, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the informant and two eye witnesses (P.W. 1, 2 and 3) have not supported the prosecution case in their testimony recorded by the trial court.
The learned AGA argued that role of shooting has been assigned to the applicant.
I have taken into consideration the submissions advanced on behalf of both the parties.
The informant and two eye witnesses having not supported the prosecution case in their testimony before the trial court, I consider it to be a fit case for bail.
Let the applicant Rajesh Yadav alias Guddu Yadav involved in case Crime No. 214 of 2005, under sections 302, 120-B, 506, I.P.C., Police station Tarwa, district Azamgarh, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
