It is submitted by learned counsel for the applicant that the role of catching hold is assigned to the applicant. The co-accused Viresh has caused injury. The co-accuse Viresh has been released on bail by this court on 10.10.2006 in criminal misc. bail application no. 21723 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Yogendra involved in case crime no. 85 of 2006 under Sections 302 I.P.C., P.S. Lodha District Aligarh be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
