In the facts and circumstances of the case writ petition filed by the petitioner is totally misconceived inasmuch as the action which is being taken for offering compassionate appointment to respondent no. 4 is based upon the directions issued by the Central Administrative Tribunal in Original Application No. 665/04 dated 11.3.2005.

Counsel for the petitioner states that the said order was passed without affording an opportunity to the petitioner.  

The proper remedy available to the petitioner is to approach the Central Administrative Tribunal by way of appropriate recall application in Original Application No. 665/04 or to file a writ petition for quashing the aforesaid order of the Tribunal.

Writ petition is accordingly dismissed.
