Layek Ram & Others v. State Of U.P. & Others - WRIT - C No. 58340 of 2006 RD-AH 18807 (7 November 2006)
Hon'ble Anjani Kumar, J.
Heard learned counsel for the parties.
The petitioners aggrieved by the show cause notice issued by the authority concerned, approached this Court by means of present writ petition under Article 226 of the Constitution of India with the allegations that the authority is proceeding in malafide manner an contrary to the direction issued by this Court in writ petition as well in the contempt petition, therefore at this stage this Court should intervene in exercise of jurisdiction under Article 226 of the Constitution for quashing of the show cause notice issued against the petitioners.
In my opinion, I do not think this to be a fit case for interference by this Court at this stage, as whatever the petitioners are stating before this Court, they can very raise before the authority concerned, who has issued show cause notices to them, including the objection or malafide. Till date none of the rights of the petitioners are affected by issuing show cause notices.
In view of what has been stated above, this writ petition has no force and is dismissed.
