Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the F.I.R. is delayed by 24 days, which was lodged on 6.5.2000 in respect of the incident which had occurred on 104.2000 to 11.4.2000. The applicant has been named only on the basis of evidence of conspiracy. The charge sheet has been submitted against the applicant then he was arrested on 28.8.2006. Other co-accused persons have been released on bail.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sanjay Kureel involved in Case Crime No. 100 of 2000, under Sections 147, 302, 201 and 120-B I.P.C. and Sections 3(2((5) of the S.C./S.T (P.A.) Act, Police Station Ekdil District Etawah be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
