Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is a women. She has been named only on the basis of doubt and suspicion. There is no direct eye witness account. It is said that one Gamchha used in the commission of the offence has been recovered at the pointing out of the applicant The case of the applicant is distinguishable with the case other co-accused Manoj.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Smt. Chhaya Devi involved in case crime no. 187 of 2005 under Sections 302 I.P.C., P.S. Paniara District Maharajganj be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
