Heard learned counsel for the applicant and the learned A.G.A. and Sri Amit Daga, learned counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant and seven other co-accused persons are named in the F.I.R. The co-accused Yogendra alias Jogendra whose case was on the same footing has been released on bail by 27.102006 in criminal misc. bail application no.19764 of 2006. Therefore the applicant is also entitled to get the benefit of parity.The same has not been controverted by the learned counsel for the complainant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Surendra involved in case crime no. 182 of 2006 under Sections 147,148,149,304,452,504,506,323,325,308 I.P.C., P.S. Datala District Meerut be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
