Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the F.I.R. is delayed by 12 days. It was lodged on 18.7.2006 at 12.15 p.m. in respect of the incident which had occurred on 6.7.2006 at 6.30 a.m. The alleged occurrence had taken place in a sudden quarrel. It was not pre-intended. It is said that the deceased has been pushed down on the Khunta, consequently, he received injury.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Babu Lal alias Bauli involved in Case Crime No. 165 of 2006, under Sections 323, 504 and 304 I.P.C. Police Station Ali Nagar District Chandauli be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
