Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is Dewar of the deceased. He was preparing for appearing in competitive examination. He was having no concerned with the demand of dowry and subjecting the deceased to cruelty. His case is distinguishable with the case of other co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Dharmendra Singh involved in case crime no. 352 of 2006 under Sections 498-A,304-B, 201 I.P.C., and ¾ of Dowry Prohibition Act P.S. Rudrapur District Deoria be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
