Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The name of the applicant has been disclosed by the co-accused Manoj. There is no other evidence against the applicant. The co-accused Har Prasad, whose case was on the same footing, has been released on bail by this court on 1.11.2006 in criminal misc. bail application no. 23324 of 2006.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Jivendra alias Bhola involved in case crime no. 402 of 2006 under Sections 364A,302,201 I.P.C., P.S. Etamddaula district Agra be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
