I have heard Sri Dev Dayal, learned counsel for contesting respondent nos. 4 to 6.
The order impugned in the writ petition is an order of remand passed in proceeding under Section 34 of the Land Revenue Act.
It is well settled that normally this court does not interfere in an order of remand unless the order is per se illegal and without jurisdiction. Equally well settled is the proposition that a writ petition filed challenging the proceeding under Section 34 of the U.P. Land Revenue Act is normally not to be entertained as the proceedings are summary in nature and subject to adjudication by a competent court on the regular side.
In view of the above, there is no scope of interference in the impugned orders.
The writ petition accordingly, fails and is dismissed.
