Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that there was no motive or intention to the applicant to commit the alleged offence. The alleged occurrence has taken place in a sudden quarrel, it was not pre-intended. It is said that from both side F.I.R. have been registered and both sides have received injuries. The injuries received by the applicant side have not been explained by the prosecution. The prosecution has not come with clean hands.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Rakesh Babu Nut alias Rakesh Kumar Nut involved in case crime no. 292 of 2006 under Sections 304,504 I.P.C., P.S. Kotwali District Auraiya be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
