We have heard learned counsel for the appellant and learned A.G.A. for the State and perused the judgment in question.
Connect this appeal with Criminal Appeal No. 6494 of 2006.
Office is directed to summon the trial court record within a period of six weeks.
It is urged that co-accused Babu Ram Singh, who was allegedly armed with his licensed gun, was bailed out by this Court on 30.10.2006. It is further urged that in cross case two persons, namely Laxmi Singh and Devi Din were injured. The appellant was on bail during trial and did not misuse the liberty of bail.
Taking into consideration the submissions made on behalf of the parties, we consider it appropriate to enlarge the appellant on bail during pendency of appeal.
Let the appellant-Rustam Singh be enlarged on bail during pendency of appeal on his executing a personal bond and furnishing two bonds of sureties, each in the like amount to the satisfaction of C.J.M., Hamirpur in S.T. No. 224 of 1994 State Vs. Rustam Singh and others.
If the appellant deposits a sum of Rs.5,000/- as fine within a period of one month from today in the court below, the recovery of remaining amount of fine shall remain stayed during pendency of appeal.
