It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. He has not been put up for identification, but during investigation his name came into light in the statement of co-accused. Subsequently, the recovery of looted part of cycle were made. The recovery was not supported by any independent witness. Co-accused Shamshad alias Shahjad, Shabbir, Munna alias Ahmad Ali, Dilshad alias Munshi, Shamshad alias Shammi and Shera have been released on bail by this court on different dates. The applicant is not having criminal antecedents.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Sadhu alias Sadaqut involved in Case Crime No. 190 of 2006, under Sections 396, 201, and 412 I.P.C., Police Station Kharkhaunda District Meerut be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
