It is submitted by learned counsel for the applicants that the applicants are not named in the F.I.R. They have not been put up for identification, but during investigation no looted property has been recovered from the possession of the applicants and there is no other reliable evidence against the applicants. The applicants are having no criminal antecedents.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Samshad Ali and Insan Ali involved in Case Crime No. 189 of 2006, under Sections 396 and 412 I.P.C., Police Station Bithaur District Kanpur Dehat be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
