It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. The name of the applicant came into light after 50 days of the alleged occurrence and the evidence of extra judicial confession have been collected by the I.O. for which it is submitted that the applicant has not confessed before any person. The applicant was arrested on 26.7.2006. It is said that from his possession two silver bangles were recovered, but in the list of articles looted from the house of the deceased the recovered silver bangles were not mentioned . There is no other evidence against the applicangt.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Amroo @ Amar Rathore involved in Case Crime No. 341 of 2006, under Sections 396 and 412 I.P.C. Police Station Kalyanpur District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned.
