Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to the prosecution version the applicant and three other co-accused persons caused injury by discharging shots. It has been specifically alleged that the shot discharged by the co-accused Karan Singh hit the deceased. The co-accused Yogendra Singh has been released on bail by this court on 5.10.2006 in criminal misc. bail application no. 21086 of 2006. The case of the applicant is on the same footing with the above mentioned co-accused persons.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Bharat Singh alias Mintoo involved in case crime no. 912of 2006 under Sections 302 and 307s I.P.C.,P.S. Amroha Nagar District J.P. Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
