Criminal Appeal No. 6801 of 2006 has been filed by Narad and Criminal Appeal No. 6802 of 2006 has been filed by Nakur Kewat against the judgement and order dated 23.9.2006 passed by Addl. Sessions Judge, F.T.C. No. 1, Gorakhpur in S. T. Nos. 90 of 2006, 91 of 2006 and 92 of 2006 whereby the appellants have been found guilty and convicted under Section 5 of Explosive Substances Act and have been sentenced to undergo rigorous imprisonment for one year and fine has also been imposed on them with default stipulation. Heard learned counsel for the parties and perused the impugned judgement.
According to learned counsel for the appellants, appellants are on interim bail from the trial Court and have already deposited the fine in the trial Court as imposed on them.
In the circumstances of the case, but without prejudice to the merits of the case, appellants shall continue on bail, during pendency of this appeal, on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
