Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is named in the F.I.R. which was lodged on 28.5.2006 at about 3.30 p.m. in respect of the incident which had occurred on 8.5.2006. The applicant has been named on the basis of doubt and suspicion. During investigation the evidence of last seen has been collected by the I.O. There is no direct eye witness account. There is no other evidence. Nothing incriminating has been recovered from the possession of the applicant or on his pointing out.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ajit involved in case crime no. 401 of 2006 under Sections 302/34 I.P.C., P.S. Sahibabad District Ghaziabad be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
