Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that according to prosecution version the alleged incident has taken place in the dark hours of night at about 2.00 a.m. on 9.5.2006. It is alleged that the co-accused Haroon has thrown acid on the deceased. It is alleged that the applicant was the companion of the co-accused Haroon but he did not thrown acid and no other act has been attributed to him.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Gulab Chandra Yadav involved in case crime no. 215 of 2005 under Sections 302,326 I.P.C., P.S. Kotwali Katra District Mirzapur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
