This is an application for bail moved on behalf of the applicant Kalloo involved in case Crime No. 857 of 2006 under section 60 ( 2) of Excise Act, Police station Jahanabad, district Bijnor.
Heard Sri S.P. Sharma, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that about five liter illicit liquor, instruments and articles used for manufacturing purpose are said to have been recovered.
The learned AGA argued that the applicant is previous convict for offences under sections 147, 148, 149, 302 I.P.C. and has been enlarged on bail by the appellate court. The learned counsel argued that the applicant misused the liberty of bail by committing the present offence.
I have taken into consideration the submissions advanced on behalf of both the parties.
Having taken into consideration the submissions advanced on behalf of both the parties and without adverting to the merits of the case, I consider it to be a fit case for bail.
Let the applicant Kalloo involved in case Crime No. 857 of 2006 under section 60 ( 2) of Excise Act, Police station Jahanabad, district Bijnor, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
