This is an application for bail moved on behalf of the applicant Rajnath Rajbhar involved in case Crime No. 36 of 2006 under sections 376, 511 I.P.C. and section 3 (i) (xi) of SC/ST Act, Police station Sarnath, district Varanasi.
Heard Sri Hari Om Rai, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that the applicant is said to have touched the face and body of minor girl aged 7 years. The learned counsel pointed out that after investigation charge sheet has been submitted for the offence under section 354 I.P.C. and section 3 (i) (xi) of SC/ST Act. The learned counsel urged that the applicant is in jail for the last about eight months.
The learned AGA submitted that the conduct of the applicant is deplorable. The learned counsel argued that the applicant after removing the garments of a girl aged 7 years was found touching her face and body.
Having taken into consideration the submissions advanced on behalf of both the parties and without expressing any opinion on the merits of the case, I consider it to be a fit case for bail.
Let the applicant Rajnath Rajbhar involved in case Crime No. 36 of 2006 under sections 376, 511 I.P.C. and section 3 (i) (xi) of SC/ST Act, Police station Sarnath, district Varanasi, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
