Heard learned counsel for the applicants and the learned A.G.A.
It is submitted by learned counsel for the applicants that the alleged occurrence has taken place in a sudden quarrel. It was not pre-intended. The F.I.R. was lodged on 15.8.2006 at about 12.50 in respect of the incident which had occurred on 14.8.2006 at about 6.00 p.m. It is said that the applicants and three other co-accused persons caused injury by using lathi, danda blows. According to the Post Mortem Examination Report the deceased has received 6 injuries in which injury no.1 was fatal but it has not been specified as to who caused injury no.1, which was on the head.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicants are entitled to be released on bail.
Let the applicants Sidhnath and Ram Sajivan Yadav involved in case crime no. 570 of 2006 under Sections 304 I.P.C., P.S. Chopan District Sonbhadra be released on bail on their furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
