This is an application for bail moved on behalf of the applicant Arvind involved in case Crime No. 208 of 2006 under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Kotwali Nagar, district Etah.
Heard Sri A. Kumar Singh, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that in the gang chart history of nine cases has been shown against the applicant out of which the applicant has been acquitted in case crime No. 156 of 2006 and in rest of the cases he is on bail.
The learned AGA argued that the applicant is habitual thief and in case of release on bail he is likely to indulge in commission of similar type of other offences.
I have taken into consideration the submissions advanced on behalf of both the parties.
The applicant having been acquitted in case Crime No. 156 of 2006 and being on bail in rest of the cases, I consider it to be a fit case for bail..
Let the applicant Arvind involved in case Crime No. 208 of 2006 under section 2/3 of U.P. Gangsters and Anti Social Activities (Prevention) Act, 1986, Police station Kotwali Nagar, district Etah, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned and an undertaking that he will not misuse the liberty of bail by indulging in the commission of crime or anti social activities after being released on bail.
