This is an application for bail moved on behalf of the applicant Chand Babu involved in case Crime No. 476 of 2006 under section 394, I.P.C., Police station Kaimganj, district Farrukhabad.

Heard Sri D.P.S. Chauhan, learned counsel for the applicant, learned AGA and have perused the record.

The learned counsel for the applicant submitted that first information report was lodged eleven days after the incident. The learned counsel argued that co-accused Chintoo has been granted bail by an order of this Court dated  3.11.2006 passed in Criminal Misc. Bail Application No. 22839 of 2006 and the case of the applicant is identical.

The learned AGA  argued that  first information report  was lodged  after inquiry about  the names of the co-accused persons involved in the offence.

I have taken into consideration the submissions advanced on behalf of both the parties.

The first information report was lodged eleven days after the incident. No recovery of looted ornaments was made from the possession or at the pointing out of the applicant. The case of the applicant is  analogous to co-accused  Chintoo, who has been enlarged on bail by this Court. In view of these facts, I consider it to be a fit case for bail.

Let the applicant Chand Babu involved in case Crime No. 476 of 2006 under section 394, I.P.C., Police station Kaimganj, district Farrukhabad, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
