Petitioner forgoes the first prayer. Therefore, there is no question of laches, which has been pointed out by the department at the time of placing the writ petition before this Court. The second prayer is a part of continuous process. However, we cannot interfere with the same in merit by holding view that the departmental proceeding can wait till the conclusion of the criminal case. Both are simultaneous unless and until any exceptional circumstance has been shown. We do not find any fruitful support of the judgment reported in AIR 1999 SC 1416 ( Capt. M. Paul Anthony vs Bharat Gold Mines Ltd. and another ) in this regard. Since we do not find any such case hereunder, we cannot entertain the same, therefore, at this stage the writ petition is treated to be disposed of only with the above observation and order.
No order is passed as to costs.
