After hearing Shri Narendra Mohan, learned counsel for the plaintiff and Shri D.P. Singh assisted by Shri Sudhir Kumar for the defendant, I find that issue No.5 should be decided as preliminary issue.  In case entire property was transferred to the two daughters by way of three sale deeds to be executed on 13.10.2003 and 25.11.2003, then nothing would remain to pass on the death of the testator  and that the will dated 04.12.2003 shall stand redeemed.

Issue No.5 as such shall be decided as preliminary issue.  List on 04.12.2006 for leading plaintiff's evidence on preliminary issue No.5.
