Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that there is a cross version of the alleged incident. From both side F.I.R. have been registered. Both side received injuries. From the side of the prosecution one person lost the life and one person sustained injuries. From the side of the applicant too one person lost the life and one persons sustained injuries. The injuries received by the applicant side has not been explained. The prosecution has not come with clean hands.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Chandra involved case crime no. 267 of 2006 under Sections 302,307,504,506 I.P.C., P.S. Kotwali Nagar District Banda be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
