Shri P.K. Ganguly appears for the plaintiff and Shri Jayont Banerji appears for the defendant.  

In this testamentary suit the plaintiff seeks, 'letters of administration' of the estate and credits of her deceased husband.  The defendant also claims to be the legally wedded wife and claims the estate and credit on the basis of a will.

A preliminary issue was decided by the Court to proceed with the hearing  inspite of pendency of suit for permanent injunction in the trial Court.  A special appeal was filed in the year 1999 in which proceedings of the suit have been stayed.

Both the learned counsels inform the Court that the plaintiff and the defendant are present in person in Court, and they wish to seek the help of the Mediation Center, to consider a settlement in the matter.

Let the matter be referred to Allahabad High Court Mediation and Conciliation Center.    Office shall draw an order on Form 'A' of the scheme and forward to the Mediation Center.  Both the parties will be present at the Mediation Center on 22.11.2006, the Wednesday, at 10.00 a.m. along with necessary papers, which they seek to rely.  The Mediation Center shall make an attempt to settle the matter between the parties.  Looking to the facts and circumstances, the parties are exempted from making any payment to the Mediation Center.

List the matter on 11.12.2006 along with the report of the Mediation Center.
