This second bail application has been moved on behalf of the applicant Farman indicted in case crime No. 828 of 2005 under sections 3/5/8 of Prevention of Cow Slaughter Act P.S. Budhana District Muzaffar Nagar.
Heard Shri P.S. Pundir , learned counsel for the applicant, learned A.G.A. and have perused the record.
The learned counsel for the applicant submitted that the applicant and eight co-accused persons were captured at the spot and recovery of two quintal beef, two tails, weights, axe, knife etc. was made from the spot. The learned counsel argued that the co-accused Baboo, Iqbal, Gulfam, Ashu, Gaffar and Jahid have been enlarged on bail by the orders of this court dated 19.1.2006, 27.1.2006 and 31.1.2006 passed in criminal misc. bail applications no. 1039 of 2006, 1336 of 2006 and 1713 of 2006 and the case of the applicant stands at par with co-accused.
The learned A.G.A. submitted that the first bail application was rejected by an order of this court dated 22.2.2006 and no fresh and additional grounds for granting bail have been arisen.
I have taken into consideration the submissions advanced on behalf of both the parties.
The co-accused Baboo, Iqbal, Gulfam, Ashu, Gaffar and Jahid have been enlarged on bail by the orders of this court and the case of the applicant is analogous to co-accused. In view of these facts, I consider it to be a fit case for bail.
Let the applicant Farman indicted in case crime No. 828 of 2005 under sections 3/5/8 of Prevention of Cow Slaughter Act P.S. Budhana District Muzaffar Nagar, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
