This is an application for bail moved on behalf of the applicant Ganesh Lal involved in case Crime No. 51 of 2006 under sections 307, 323, I.P.C., Police station Karari, district Kaushambi.
Heard Sri Anirudh Kumar Mishra, learned counsel for the applicant, learned AGA and have perused the record.
The learned counsel for the applicant submitted that injuries of both the injured are of simple nature. The learned counsel pointed out that in the X-ray of injured Mahesh small radio opaque shadows of metallic density were seen in the skull face and shoulder. The learned counsel urged that there was no motive for the commission of offence.
The learned AGA argued that role of opening fire at the injured has been assigned to the applicant and injuries are on vital part of the body.
I have taken into consideration the submissions advanced on behalf of both the parties.
In the X-ray of the injure radio opaque shadows of metallic density having been found and injuries being skin deep, I consider it to be a fit case for bail.
Let the applicant Ganesh Lal involved in case Crime No. 51 of 2006 under sections 307, 323, I.P.C., Police station Karari, district Kaushambi, be enlarged on bail on furnishing personal bond with two sureties each in the like amount to the satisfaction of the court concerned.
