Heard learned Counsel for the applicants and learned A.G.A.
It is submitted by learned counsel for the applicants that there was no motive or intention for the applicants to commit the alleged offence. The F.I.R. is delayed. It was lodged on 24.8.2006 at 4.35 p. in respect of the incident which had occurred on 23.8.2006 at about 9.00 p.m. It is said that the applicants and 2 other co-accused persons caused injury by using lathi and danda blows. The deceased has received only one injury. It has not been specified that whose blow hit the deceased.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicants and without expressing any opinion on the merits of the case, the applicants are entitled to be released on bail.
Let the applicants Om Prakash and Sonu involved in Case Crime No. 837 of 2006, under Sections 304, 323 and 504 I.P.C. Police Station Loni, District Ghaziabad be released on bail on their furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
